This website is operated by The Gay Farmer’s Vodka. Throughout these Terms of Service, the terms “we”, “us” and “our” refer to The Gay Farmer’s Vodka.

These Terms of Service apply when you access our website, create an account or purchase products from us. By using this website, you agree to these Terms of Service and our Privacy Policy

If you do not agree to these Terms of Service, you should not use this website.

Our online store is hosted by Shopify, which provides the ecommerce platform that allows us to sell our products to you.

Nothing in these Terms excludes, restricts or modifies any consumer right or guarantee that cannot legally be excluded, including rights provided under the Australian Consumer Law.

1. Alcohol sales and age requirements

You must be at least 18 years of age to purchase alcohol from this website.

By placing an order, you confirm that:

  • You are at least 18 years old

  • The information you provide is accurate and truthful

  • You are legally permitted to purchase alcohol

  • You are not purchasing alcohol on behalf of a person under 18

  • The person receiving the delivery is at least 18 years old

We may use an age-verification service or request acceptable proof of age before accepting, processing or delivering an order.

A delivery driver may request proof of age from the person accepting an alcohol delivery. Delivery may be refused if suitable identification cannot be provided, the recipient is under 18, or delivery would otherwise be unlawful.

It is an offence to obtain alcohol on behalf of a person under 18.

2. Accounts and customer information

You may be required to provide your name, email address, telephone number, billing information, payment information and delivery address when using this website or placing an order.

You agree that the information you provide will be current, complete and accurate.

If you create an account, you are responsible for maintaining the confidentiality of your login details and for activity undertaken through your account. Please notify us promptly if you believe your account has been accessed without your permission.

You must not transfer, sell or provide your account to another person.

3. Products and product information

We take reasonable care to ensure that product descriptions, photographs, pricing and other information displayed on this website are accurate.

Product colours, packaging, labels and appearance may vary slightly from images displayed on your screen. Packaging and product details may also change from time to time.

All product descriptions and availability are subject to change. We may discontinue a product or restrict the quantity available for purchase at any time.

Any tasting notes, serving suggestions or other product information provided on this website are general in nature. Individual experiences and preferences may vary.

4. Orders

When you submit an order, you are making an offer to purchase the products in your cart.

An order confirmation acknowledging receipt of your order does not necessarily mean that we have accepted it. We accept your order when we confirm that it has been processed or dispatched.

We may decline or cancel an order where:

  • A product is unavailable

  • There is an error in the product description or price

  • Payment cannot be processed or verified

  • We reasonably suspect fraud or unauthorised payment

  • We cannot verify that the purchaser or recipient is at least 18

  • Delivery to the nominated address is unavailable or unlawful

  • The order appears to be intended for unauthorised resale

  • Accepting the order would breach a legal or licensing requirement

If we cancel an order after payment has been received, we will refund the amount paid for the cancelled products using the original payment method.

Please check your order carefully before submitting it. If you need to change or cancel an order, contact us as soon as possible at hello@thegayfarmersvodka.com.au. We cannot guarantee that an order can be changed or cancelled after it has been processed or dispatched.

5. Prices and payment

Unless otherwise stated:

  • All prices are displayed in Australian dollars

  • Prices include GST and other applicable taxes

  • Delivery charges are calculated separately and displayed before you complete checkout

We may change our prices at any time. A price change will not affect an order that we have already accepted, except where there has been an obvious pricing error.

You must be authorised to use the payment method supplied with your order. Payment is subject to approval by the relevant bank, card issuer or payment provider.

Discount codes and promotions may be subject to additional conditions, expiry dates, product exclusions and usage limits. Unless otherwise stated, promotional offers cannot be used together.

6. Shipping and alcohol delivery

We only deliver to locations permitted by our liquor licence, delivery provider and applicable laws.

Estimated delivery times are provided as a guide and are not guaranteed. Delays may occur due to carrier disruptions, severe weather, high order volumes or other circumstances outside our reasonable control.

You are responsible for:

  • Providing a complete and accurate delivery address

  • Ensuring alcohol delivery is permitted at the nominated address

  • Ensuring a person aged 18 or over is available to receive the delivery where required

  • Providing any delivery instructions needed to complete the delivery lawfully and safely

Alcohol will not be left where doing so is prohibited by law or contrary to the delivery provider’s responsible delivery procedures.

Proof of age may be required at delivery. The driver may refuse delivery if the recipient cannot provide acceptable identification, is under 18, appears intoxicated, or if completing the delivery would otherwise be unlawful.

If delivery cannot be completed because the customer supplied incorrect information, no eligible adult was available, acceptable identification was not provided, or delivery was otherwise refused for a reason attributable to the customer, additional redelivery or return costs may apply.

Responsibility for the products passes to you when the order is delivered to the nominated address or collected by an authorised recipient, subject to your rights under the Australian Consumer Law.

7. Returns, refunds and consumer guarantees

Purchases made through this website are subject to our Refunds and Returns Policy [INSERT LINK - Jim’s team will do this].

Our products come with guarantees that cannot be excluded under the Australian Consumer Law.

If a product has a major problem, you may be entitled to choose a refund or replacement. If a problem is minor, we may choose to provide an appropriate remedy within a reasonable time.

Nothing in these Terms or our Refunds and Returns Policy excludes, restricts or modifies your rights under the Australian Consumer Law.

8. Responsible consumption

Alcohol should be consumed responsibly and in moderation.

You are responsible for the safe and lawful possession, storage and consumption of products purchased from us.

You must not supply alcohol purchased from us to a person under 18 or to any person where doing so would be unlawful.

Our store is hosted by Shopify, which provides the ecommerce platform used to operate this website.

Products purchased through this website are sold by The Gay Farmer’s Vodka, not Shopify. Questions, complaints and claims relating to an order should be directed to us using the contact details at the end of these Terms.

Your use of Shopify-supported features may also involve the processing of information by Shopify in accordance with its applicable privacy terms.


12. Privacy

We collect, use, store and disclose personal information in accordance with our Privacy Policy.

Because our store is hosted by Shopify, information submitted through this website may be processed by Shopify and other service providers, including providers located outside Australia.

We are not responsible for loss caused by:

  • Events outside our reasonable control

These Terms are governed by the laws of Victoria, Australia.

You and The Gay Farmer’s Vodka submit to the non-exclusive jurisdiction of the courts of Victoria and any courts entitled to hear appeals from them.

Nothing in this section prevents you from exercising any rights available under the Australian Consumer Law.

24. Changes to these Terms

We may update these Terms from time to time by publishing a revised version on this website.

The updated Terms will apply from the date they are published and will not retrospectively alter an order that we have already accepted, unless required by law.

The date of the most recent update should be displayed at the beginning or end of these Terms.
